Interesting that she was only charged with negligence and fined. Almost like a workplace safety violation. Any bets it would have been a murder charge here?
It does bring up the idea of safety issues around bondage rigging and a tops ability to get the sub out in a hurry (or at least into a safe position.) Regardless of how else he was bound if she could have gotten him on the floor and the tension off of his neck he probably would have been OK>
Rope (especially under tension) is easy to cut with a sharp knife or safety shears) One of those auto rescue tools with a seatbelt cutter is also a handy thing to have around. If chain is used there are also quick release snap shackles that can be tripped while under tension.
If nothing else this demonstrates the importance of playing with a Domme who is skilled in the areas of play you want to explore. When it comes to bondage it's about the ability to foresee problems and having a plan to deal with them.
Unfortunately, I have found over the years that there are some Pro Dommes who are relatively unskilled when it comes to more elaborate or intense bondage.
I'm curious as to how much contingency planning Dommes engage in when planning a session? Have you ever had a sub pass out or suffer some other medical emergency?

This is a bit like in the scifi book by A Stranger in a Strange land by Heinlein.
In the scifi story, there is a human who was raised from infancy on Mars and he has all kinds of crazy special magical powers, which he uses on return to earth, and these powers include making some people disappear, which is a gentle way of killing them.
Anyway, some of the people killed find themselves in the afterlife discussing with others how and why they are there, in the afterlife rather than in real life . . .
Supposedy, in our reality, there are people who die, either permanently or temporarily, and find themselves in the afterlife with God or angels, and God or angels or others say, approximately, "You are not supposed to be here," or "You are not supposed to be here now, etc."
oh boy!
I am glad that God, if there is a God, has a plan to fix things such as accidental deaths!

You asked what a domme/mistress might be charged with in the US or the English speaking lands if and when a similar situation took place.
I think we know, in part, because of the July 2000 case of Barbara Asher. Asher was accused of manslaughter based on her own unrecorded confession which was later denied or retracted. No body was ever found and the jury ended up acquitting her, even though she might have been guilty. There is also the Daniel Penny case with the black homeless guy on the subway!
However, there were two many questionable facts to make a guilty verdict easy.
Anyway, back in July 2000, a Quincy, Massachusettes domme with a makeshift dungeon saw a client. The client was overweight and may have had other health problems.
Anyway, she was charged with involuntary manslaughter and not with murder. The guy reportedly had a heart attack and for several minutes she did not take action to save his life, or so it was claimed by the prosecution.
I think that there are usually 2 degrees of manslaughter and that the involuntary manslaughter is the least serious of the manslaughter charges.
I think that involunary manslaughter is about the same as negligent homicide, the charge in the German strangling case!
Oh, I am missing something. For example, in the case of Daniel Penny, he was charged with both manslaughter and "negligent homicide." The manslaughter charge was more serious and was dismissed first, and then, after a little more deliberation, the jury found not guilty on the negligent homicide charge.
